JAR Text Message Program

Terms & Conditions

“JAR”, "Company", “We", “Us” or “Our” means JAR LLC, an Illinois limited liability company, and its agents, affiliates and subsidiaries.

These JAR Text Message Program Terms and Conditions (The “Terms and Conditions”) represent an agreement between JAR and you (“you” and “your”) when you use the JAR Text Message Program as described in these terms, as may be amended from time to time. By opting-in to the Program (as defined below), you agree to these Terms and Conditions and JAR’s Privacy Policy [www.jar.pro/privacy] and you consent to JAR sending you Short Messages (SMS) to the phone number provided by you to JAR, including those SMS sent through the use of automated technology. JAR will not share the phone number you provide with third parties. You agree to receive SMS messages from [847.926-9476] to the provided phone number, and you confirm that you hold the JAR client account corresponding to the phone number you have entered, or that you have the JAR client account holder’s permission to use this service.

Consent to these Terms and Conditions is not required as a condition of purchase and is not required as a condition of using JAR’s products or services.

Neither JAR nor any mobile carriers are liable for delayed or undelivered messages.

You can at any time access the latest version of these terms via our website.

JAR Text Message Program Description: We will periodically send SMS to you including updates about any project, work, product or services that we have provided, are providing, or may in the future provide, offer, market, advertise or promote to you, as well as deals, promotions, offers and other marketing content from our contractors and providers of related services with whom we have a contract (the “Program”). Message frequency will vary.

How to Opt-In: You may opt-in to the Program by requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more text messages, by replying “Yes” to [847.926-9476] or by By clicking “I agree” on JAR’s Website. you will be bound by these Terms and Conditions.

How to Opt-Out: To opt-out from future SMS marketing messages from the JAR Text Messaging Program, text STOP to [847.926-9476]. You can also opt-out by contacting JAR customer service at 847.926-9476. Please note that once you opt out from SMS, you will no longer receive marketing SMS communications from JAR, but you may be asked to sign up for the JAR Text Message Program again. You may also continue to receive other marketing communications from JAR such as emails. Once you opt-out, we will send a single confirmation opt-out and will then cease sending you text messages from the short code associated with the JAR Text Message Program unless you opt-in again.

How to Opt-In after Opting Out: If you have opted out from our SMS Program and want to restart using the SMS services of JAR, text START to [847.926-9476].

Supported Carriers: Supported carriers may change from time to time. Not all carriers may support our SMS program.

Delivery: We do not guarantee that you will receive any SMS under the Program. Circumstances beyond our control, including network issues, may result in your not receiving our SMS. Neither your carrier nor JAR are liable for delayed or undelivered text messages. Carriers are not liable for delayed or undelivered messages.

Eligibility

To be eligible to use the JAR Text Message Program, you must:

be a U.S. resident;
have a U.S. mobile phone number; and
be able to receive security verification codes via text message, please note that Voice over IP (VOIP) numbers are not supported.

Changes to Terms and Conditions: We may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to our website. You agree to review these Terms and Conditions periodically to ensure that you are aware of any changes.

Program Termination: We reserve the right to modify or discontinue, temporarily or permanently, all or any part of the Program, with or without notice.

THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER THAT AFFECT YOUR RIGHTS. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION SECTION BELOW.

Opting In.

By Opting In to the Text Message Program:

· You authorize JAR to use non-autodialer and autodialer technology to send text messages to the cell phone number associated with your Opt-In (i.e., the number listed on the Opt-In form or instructions, or, if none, the number from which you send the Opt-In, or, if none, the number on file for the account associated with your Opt-In). You also authorize JAR to include marketing content in any such messages. You do not have to Opt In or agree to Opt In as a condition of purchasing any service or product.

· You are signing your Opt-In to the Text Message Program.

· You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to Opt In.

· You consent to the use of an electronic record to document your Opt-In. To withdraw that consent, request a free paper or email copy of the Opt-In, or to update our records with your contact information, please call 847.926-9476. To view and retain an electronic copy of these Terms & Conditions or the rest of your Opt-In, you will need (i) a device (such as a computer or cell phone) with internet access, and (ii) either a printer or storage space on such device. For an email copy, you’ll also need an email account you can access from the device, along with a browser or other software that can display the emails. These Terms & Conditions still will apply if you withdraw the consent mentioned above or opt out of the Text Message Program.

After Opting In, in addition to the main messages the service offers, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your Opt-In.

About the Text Message Program and Opting Out.

Message and data rates may apply. Unless otherwise noted, the JAR Text Message Program may send multiple, recurring text messages to you. Message frequency may vary. JAR may terminate the Text Message Program or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these Terms & Conditions still will apply. For services operated through [847.926-9476], you can get help by texting HELP to through [847.926-9476], and you can opt out by texting STOP to through [847.926-9476]. For Text Message Program services operated through a different number, text HELP to that number for help and STOP to that number to opt out. Your opt-out request may generate either a confirmation text or a texted request to clarify the Text Message Program service to which it applies (if you have more than one). To complete your opt-out, please provide the requested clarification.

Disclaimer of Warranties

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the our website https://www.jarcorp.net/, including any content, functionality and services offered on or through https://www.jarcorp.net/ (the “Website”) or via the Program will be free of viruses or other destructive code. Use of the Website is subject to our Website Terms and Conditions, available here: http://www.jar.pro/terms. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our Program and website for any reconstruction of any lost data. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR PHONE, MOBLE DEVICE, TABLET, COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE PROGRAM OR THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

YOUR USE OF THE PROGRAM, THE WEBSITE, THE CONTENTS AND SERVICES AVAVAILABLE VIA THE PROGRAM OR THE WEBSITE, AND ANY PRODUCTS, SERVICES OR ITEMS OBTAINED THROUGH THE PROGRAM OR THE WEBSITE IS AT YOUR OWN RISK. THE PROGRAM, THE WEBSITE, AND THEIR CONTENTS AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PROGRAM OR WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, NEITHER JAR NOR ANYONE ASSOCIATED WITH THE JAR REPRESENTS OR WARRANTS THAT THE PROGRAM, THE WEBSITE, THE CONTENTS OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PROGRAM OR THE WEBSITE WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR PROGRAM OR WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE PROGRAM, WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PROGRAM OR WEBSITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation of Liability

IN NO EVENT WILL JAR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PROGRAM, THE WEBSITE, ANY WEBSITES OR SERVICES LINKED TO OR AVAILABLE VIA THE PROGRAM OR THE WEBSITE, ANY CONTENT SHARED OR AVAILABLE OR ACCESSIBLE VIA THE PROGRAM OR THE WEBSITE. IN FURTHERANCE AND WITHOUT LIMITING THE PREVIOUS SENTENCE, IN NO EVENT WILL JAR, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify and hold harmless JAR, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms and Conditions, the Terms of Use, or your use access to or use of the Program or Website, including, but not limited to, information that you include in any messages that you send in connection with the Program or any use of the Website’s content, services and products other than as expressly authorized in these Terms and Conditions, the Terms of Use.

Governing Law and Jurisdiction

All matters relating to the Program, Website and these Terms and Conditions, the Terms of Use, the Privacy Policy and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice or conflict of law provision or rule (whether of the State of Illinois or any other jurisdiction).

Any legal suit, action or proceeding arising out of, or related to, the Program, these Terms and Conditions or the Website or its Terms of Use shall be instituted exclusively in the federal courts of the United States or the courts of the State of Illinois in each case located in the City of Chicago and County of Cook although we retain the right to bring any suit, action or proceeding against you for breach of these Terms and Conditions or the Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THE PROGRAM, THESE TERMS AND CONDITIONS OR THE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Waiver and Severability

No waiver by JAR of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.

Mobile carriers.

The [847.926-9476], short code we use for the Text Message Program is supported on all major U.S. mobile carriers. Please note, however, that the supporting mobile carriers may change without notice, and the Text Message Program you join, including whether operated through a different number, may be limited to specific carriers. JAR and the mobile carriers (for example, T-Mobile) are not liable for delayed or undelivered messages.

Entire Agreement

These Terms and Conditions [www.jar.pro/terms], Terms of Use, our Privacy Policy [www.jar.pro/terms], and any open account agreement between you and JAR constitute the sole and entire agreement between you and JAR with respect to the Program and the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Program and the Website.
